Recommendation for Gang (s) Management; Under the Requirement that, All Gangs Operating In The State Of Colorado must Obtain Liability Insurance Coverage, In The Interest Of Public Safety.

Required Licensing And Registration

The focus, under the proposed initiative The Colorado Gang Organized Business Act’s (Gang Code) regulation and gang management, specifically, from the prospective of   public safety. Wherein under such the issue of  the lobby efforts for legislative laws to be passed that, would require gang organization to be bonded and  carry liability  insurance under the regulations of the (Gang Code).  

Retrospectively, the same as any, business, organization that move about the public; in a like manner as, as required of any law enforcement officer whom must ethnically observe the laws when dealing with the public, so shall the gang organization be held accountable for their movements and interrelations, within the public. More importantly,  gang organization “shall” become responsible for public safety while carrying out their activities, meetings, gathering, and parting, too include rival gang encounters.

Since gang life is a chosen way to live, Therein lays the existed elements of unpredictability. Therefore, under the proposed initiative, a legislative law would be passed, that shall include the required imposition of bonding and insurance. To become statutorily regulated action to be required of all gang organization , resulting in direct interference by the state or government; thereafter discouraging the desire to engage in gang activity.

By the newly proposed legislative requirement, all gang organization will maintain a clean license and liability Insurance policy. In addition, shall complying with any other type of license requirements, such as driver’s licenses as of which under the classification of gang member. Under the legislative intent, there would be the requirement that, a gang member must maintain all other required licenses.

Under the Public Safety and Responsibility (ACT) an proposed additional act to be passed in support of the overall initiative, by the simple enforcement and education suggesting the observance of all licensing requirements and regulation towards all gang organization as a group. Following such emphasizing, that in the event a single gang member is, found to be, operating without a license or insurance. Such a gang member shall be held as a (liability) toward the main Gang Organization as a group classified entity, from which he or she belongs. In such cases, the gang organization will be, fined for any member found to be in violation. Thus, following such violation at cause; the Gang Organization will become engaged with the secretary of states internal affairs, until the member (s) in violation are brought in to compliance, with a valid license and proof of liability Insurance with the states internal affairs. To be done under the legislated gang regulation. As a proposed suggestion; this may involve the traffic courts system, in such cases. The engagement with the state will remain active until such court matters have been resolve, by both the gang organization and their member in violation has paid the fines as imposed.

 In a like manner, as any other regulated profession such as, insurance agent, agencies, collection agencies and collectors, nurses, doctors, lawyers and any other known regulated profession; emphasizing that, [G]ang Organizations and its members, are in fact a chosen profession. Each individual, as members or for all point and purpose, are engaged in their selected choice of profession… no matter, the level of their professionalism. It shall, be regulated by the state as a liable organization and profession.

All Gang Members and Gang Organization, shall, undergo registration due process, and pass state orientation exams. Under such, they must become familiar, with the rules and regulations of the laws regarding various statutes and the Uniform Commercial Code; (currently) known to be broken by and or violated by Gang Members prior, leading to their convictions for criminal activities. Moreover, under the proposed Colorado State Gang Organized Business Act’s (Gang Code). Should, a gang member be confronted by a Regulations Officer, and that (Officer) he or she, has determined that, a person is acting unregistered. The Gang Organization named, thereafter shall be, fined for their unregistered member. The unregistered member (person) shall be, summonsed to civil court to answer the complaint. Whereat, an fine a fine assessment hearing will be held in determination of the fines assessment, towards both the gang organization and the (person) whom was found to be acting as an unlicensed gang member.

          Thereafter, upon the failure to comply with the fine payment arrangement shell be converted in to a 10-day jail sentence for violation of registration for first offence failure. The court may consideration the recommending for reeducation, in the form of anti gang member classes.

The concept behind the program registration and license, where it is used to help young gang members realize the depth of the responsibilities in the undertaking of the perpetration of a gang organization to which is regulated under the law. It is hoped to acclimate them of the laws, under the requirements of management,  under the requirements of regulations, and the requirements of compliance. Including, the objectively implied consequence, of what happens when organization are not in compliance with the various state departments, who are responsible for the enforcement of statutory laws and its administrative schemes, including the necessary, and proper  paper work involved with being a gang member as apart of a Gang Organisation.

Under the proposed initiatives gang management requirements; by the state’s  hands on approach, thereafter, will change a young misguided, inconsiderate and irresponsible gang member into a responsible gang member. Ultimately, encourage them to get further education and stay clear of gang activities. For it is a lot of paperwork involved with being a gang member, that one must obtained and receive  a licenses from the state to operate as a gang organization, where in after  such member (s) must agree under the Gang Code, not to break state laws.

Ultimately, this will take the fun! Out of GANG BANGING, converting it in to a professional undertaking ( outside the current criminal element of engagement, as currently done by the legal-justice system, and local law enforcement agencies), under the proposed initiative of gang management, a form of self gang management, in the form of limited amnesty in exchange for compliance, shall exist with organizational participation. Thereafter, under such, all gang applicants… shall be asked: (one) what value will the gang organization contribute towards the public’s interest? , and (two) in what form will the gang organization contribute towards the prevention of gang violence? The Secretary of State shall, under the regulatory scheme of the (Gang Code) require the gang organization to submit a mission statement towards this single objective interest, the verification of the gang organization’s interests and intent towards public safety.

The Recommendation for Gang Management, Through The Colorado Secretary Of State. The Initiative Proposes the Imposition of Regulatory Control Over Radical-Rebellious Organizational Operation In Violation Of State Statutory Business Requirement Of Registration And Licensing When Operating Any Form Of Business For profit Or Non Profit.

LOBBY EFFORT

      The proposed initiative, seeks to lobby for a new legislative laws to be passed that, would give the Colorado Secretary of State, the ability to secure the public’s safety through a specific regulatory scheme. First, for consideration is the fact, that gangs are not regulated by any city or state ordinances, statutes. Thus, becoming an critical point of view for further consideration under the proposed initiative of gang management. Secondly, asking the question as to why should gangs be free from state and local business ordinances, regulation requirements of licenses and registration like any other organization for profit or non-profit, as a business?

 Under the initiative as proposed it will suggest that, Gangs should be required to register and obtain licenses and establish grounds for its creation and existence, whether friendly or non-friendly regardless; all gang organizations, must be required under the new laws to become registered and regulated by the Colorado Secretary of State, and to be required to register in addition, under Revenue Departments.  Whereat,  all Gangs in operation in the state of Colorado, must pay taxes on all earned income or cash generation… like, all other organizations for non-profit, and or business for profit.

Regardless, gangs are in fact an organization, and shall be classified as an organized business, whether legal, or illegal, matters not under the proposed initiative. Therein-under, the new proposed laws, there would be specific (recommendation) as a consideration, pursuant to the “don’t ask- don’t tell regulation”, where it matters not… how a business transaction it is documented. Where, one must consider the facts, based upon that, if a fundraiser, back yard sale, auction, sales of services, bake sales, street market sales, any other cash revenues must be accounted for. Thereafter, the taxes are paid and the revenues properly reported, this is the end of the transaction as in trusted to any licensed vendor, retail businessman, restaurants, citizens engaged in special events,  or Gangs who generate revenues) it is the responsibility of the seller, the business, or the organization… to collect, the required taxes at the point of sales. (Regardless, as such to be done "revenue is revenue")... "Seen or unseen"... "call it this or call it that"! makes no difference pursuant to an  requirement to be done. 

Under the proposed law, it shall not ask... the where or the how,  pursuant to the “don’t ask- don’t tell regulation” nor, shall the law give reason, to intrude into the affairs of those who have sold something… only that, the requirement they follow the rules. Nonetheless, if the gangs, and or its members are not as crafty under their hand of business, in comparison with other legitimate organization. As of whom, are required to register and pay taxes. Then this is a problem, that a gang organization, and  its members must face on their own. Their only allowed solution, under the new law, is to obtain legal advice. Moreover,, become compliant like everyone else.

Initiative Objective:   To identify child neglect imposed unknowingly by a modern parents. In addition, to identify young adults who were victims of early neglect, of none supervision. the cause of in neglected child or young adult, unsupervised, giving them the  freedom to join a gang without any! parental restraint.

Argument and Suggestive proposed impact on Colorado’s: gangs, the public at large, Colorado’s government, public safety, gun control, parents, children, young adults, individual communities, courts, and you the residents of the state of Colorado.   

Areas of impact, cause, effect, and the solution:

•  (The initiatives' Solution) Will affect the gang population by decreasing further recruiting, and gang violence.
• The proposal, (Will) directly, affect gang members.
• (The initiatives' Solution) will provide effective gang management administration.
• (The initiatives' Solution) will provide early detection of potential rouge radicalized young adult.
• The proposal, (Will) address the (Causes), of failed educational system that is currently out dated by is objective. 

• The proposal, (Will) address the (Effect) of abandoned disciplinary actions for out of control children.
• The proposal, (Will) address the (Effect) of abandonment of early supervision of children from the  ages of 0-6, from the ages of 6-12, from the ages of 12-16, from the ages of  16-18, and should consider ages 18-21.
• The proposal, (Will) address the (causes) of the communities, and public's denial, that, the problem of misguided children, and young adults stems from parental neglect and psychological child abuse.

• The proposal, (Will) address (causes) of the People’s misplaced ideas of gun control, as a deterrent to limit access to high capacity magazines. When in fact,that various young adult, suffers from mental disorder in most cases, such disorders, existed long before the manufacturing of the high capacity magazine.

GUN CONTROL BY TACTICAL REGULATIONS

 Ø  Under the misconceived idea, that the banning of a high capacity magazine, becomes a slippery slope, from which to climb.  Flowing now, to the initial back ground checks, as of which is only a solution for the honest law abiding citizens. However, instead of pursuing and agenda to band high capacity magazine. In the alternative, one should look... towards, registration and penalties as a solution. Under such, will require the tracking of registrations and penalties for the non-compliance. This type of requirement will put a powerful tool in the hands of the regulators, so as to speak! One, the proposed initiative,  will give us a look at who would buy such things as high capacity magazines.  Two, the proposed initiative, will give us a reason to place check points, within the requirement of stress testing, like airline flight attendants, and police officers alike, must under go psychological testing every so many years. In a like manner, so should laws be put in place to check the balance of the owners of such powerful weapons, while respecting their right to have and own fire arms regardless of its kill capacity. Moreover, it is our duty to keep the gun owners safe; them from the public, and the public safe from them as well. All person owning high capacity weapons and similar lethal maxim yield weapons, shall under go a process of evaluation and licensing and by imposing insurance requirements allows the ability to track all weapons sold. In addition, will allow us to track the mental stability of all gun owners. The invention of the weapons inspector, will keep all owners of weapons  in compliance under the newly proposed initiative. Therefore, protecting the right to bear arms as defined under the Second Amendment to the Constitution of the United States,  thereafter, for consideration as an enhancement the proposed initiative suggest that, the right to bear arms, include to do so, that this right! shall be ultimately carried out responsibly, this is the overall goal of the proposed initiative, under The Colorado Gang Organized Business Act's (Gang Code). 


THE RIGHT TO BEAR ARMS IS SET IN STONE UNDER THE CONSTITUTION;

           THUS, WE CAN ONLY TACTFULLY REGULATE  THROUGH AN REQUIREMENTS OF TESTING THE MENTAL CONDITIONS OF THE OWNERS OF ANY FIREARM IN COMPLIANCE WITH THE IMPOSED REQUIREMENT OF INSURANCE COVERAGE. [LIABILITY INSURANCE] FOR ALL GUN OWNERS. 

        FURTHERMORE, AS AN EMPHASIZED AND  KEY POINT, GANG MEMBERS DO NOT FOLLOW THE RULE OF CLEARING BACK GROUND CHECKS. NOR, DO BACK GROUND CHECKS DETOUR  OR PROPERLY DETERMINED MISGUIDED INDIVIDUALS SET ON MASS MURDER OR DOMESTIC TERRORISM . HOWEVER, BY IMPOSING REGULATIONS ON THE GANGS THROUGH THE  COLORADO GANG ORGANIZED BUSINESS ACT, IT WILL CAUSE THE TRICKLE DOWN EFFECT, INTO THE MAIN STREAM OF SOCIETIES  AWAKEN AWARENESS, AND EDUCATION. 

       CLEARLY PROVIDING, ONE STEP IN THE RIGHT DIRECTION, IN THE IDENTIFICATION OF POTENTIAL MISGUIDED INDIVIDUALS, BY EDUCATING THE MASSES ON WHAT TO LOOK FOR. THE C.C.O.B.A.  WILL INSTALL EYES AND EARS THROUGHOUT THE COMMUNITIES.

FURTHER Areas of impact, cause, effect, and the proposed solutions that;

• Will address (causes) of the (in denial) issue that the mass mind is unable to process the reality of the consequential events that have followed behind their insensibility towards their first priority of properly educating their of spring in today’s ever changing world traveling at the speed of light.

• Will address the (causes) of inevitable reality that, the average parent have drifted far left of traditional parenting and have become lazy parents under the continuation of down graded lack or diminishing disciplinary action and morality training of their young.

• Will address the consequence (effect) of the abandonment of proper disciplinary action and morality training, that have evolved through thousand of years of trial and error. However, the modern parent have chosen to over look the animalistic human quality as it exist in absent of education and moral training. Resulting in destabilization of correct training,  resulting in the child's fast tract, to growing up! without values of reinforced responsibility.

• Will address the duty and responsibility of the government to effectively draft and pass corrective legislation towards properly educating parents of updated   parenting  methods and child development assessment.

• As a result, The following is a proposal directly addressing the gang problem statewide. With in is a solution to the gang problem in unison with current laws that are already on the books. In addition the proposal of the passing of additional complementary enhancing statutory laws.

Emphasizing the fact that, because the gang is an organizational group, may or may not be criminal in nature. Creates a problem, in the classification of gang affiliates... Realizing the potential consideration that perhaps the act is mealy a identification issue,crises or  just a fad passing in time. Unfortunately, the authorities and parents alike, spend vast amounts of time money, and other resources chasing the young juveniles, who are acting out  through a phase. On the other hand, the facts point to the evidence that, this phase is serious and reflective of an organization left unsupervised. Children in operation, as an organized unit for their own purposes of committing crimes and terrorizing others for fun, or each other under the guise that, they swear legions towards a code of conduct to protect their way of life, however misguided, this is the reality of gang life!  Unfortunately, the parents of such children, and young adults as a whole have failed to properly put down this type of rebellion.

The mere existence of gangs, reflects, the parents inability to control or influence their own offspring. Thus, society is full of free radicals, as of (Whom) are, allowed to run-a-muck at every level, (why?) Because, the people and the elected official never stop to correctly assess this reality. Flowing now to the current reality that, of out of control young adults who freely move about the society as a ticking time bomb, as of whom randomly go off! exercising their distorted claim to fame through the available horrific mass mind set currently as programmed into society. No different than its earlier predecessor created back in the early  70s, and   80s; the infamous plane hijackings, as done for an reason, for some! Others for fame,political agenda, or media attention. 

Today such agendas have evolved into “the tool of jihad's” grand deception that, cultivate and recruit the young and misguided. Reminding, you and I of today's agendas of the misguided young adults, who seek to carryout horrific events, such as the Columbine High School Massacre, and other such spectacles as the  Aurora Theater Shooting, and the manifestation of the Sandy Hook Elementary School shooting massacre.  All are the result of unchecked, and unregulated rebellious activities of the young undeveloped Teenage Brain the mind. Who are, radicalized by the current free information as imposed by the internet's freedom of expression. fueled by the media's  freedom of the press,  and most importantly that, of the First Amendment to the United States Constitution' freedom of speech? However unfiltered, leaves the door open for the radicals, and rebels to gain instant fame, complements of the major media networks uncensored… in reality... some thing should not become a mass media event of influence. Hence, under the proposed initiative, we are lobbing laws... needed to stop, the  giving of ideas! to the sick!  and weaker minds! as of whom, get their influence from the media and the internet of uncensored events.
